Terms and Conditions
These Terms and Conditions form a client agreement between you the client (hereby referred as you, your) and Bump2Breast Lactation, ABN 21 209 073 631 (also referred to as the Lactation Consultant, we, us).
These Terms and Conditions also include the Fees payable, which can be viewed on the Services page of this website. Fees are subject to change and will be updated on the website and bookings link as they occur. “Fee” means the fees set out on the Website/bookings link plus any applicable Travel Fees.
In making a booking with Bump2Breast Lactation you are accepting these Terms and Conditions and Fees.
1. Description of service
These Terms and Conditions relate to services provided by Bump2Breast Lactation which include; pre and postnatal breastfeeding, chest feeding and lactation support and management via in person consultations and tele-health. Bump2Breast Lactation does not provide antenatal or intrapartum/labour care.
2. Bookings
All clients will receive an initial booking confirmation via email and SMS.
A New Client Antenatal or Postnatal Intake form must be completed a minimum of 24 hours prior to your initial appointment with Bump2Breast Lactation. This intake form will be contained via hyperlink in your booking confirmation email. It is also available to complete on the Services page.
An SMS appointment reminder will be sent to you 24 hours before your appointment time, which must be confirmed via Y/N acceptance.
In cases where confirmation has not been received, Bump2Breast Lactation will reasonably endeavour to contact you to confirm your appointment and obtain pre-appointment intake documentation.
By booking your appointment you are accepting Bump2Breast Lactation’s cancellation and ‘no show’ policy and Fees as outlined in these Terms and Conditions.
3. Fee schedule and Payment
You accept the Fees as it pertains to the relevant packages and Services you have booked. Payment must be made at the time of booking to secure your appointment. Payment for Services can be made via debit or credit card via third party payment system Stripe.
4. Travel Charges
All appointments outside the included travel distance, will incur a travel charge, as set out below.
“Travel Fees” are calculated as $1.00 for each kilometre travelled past a 40km radius from Kuranda, Qld. Travel fees may be “waved” at the discretion of the Lactation Consultant.
5. Cancellation policy (cancellation and ‘no show’)
A minimum of 24 hours notice must be give for rescheduling of appointments.

Any cancellation less than 24 hours of your appointment time will incur a cancellation fee of 100% of the consultation fee.
Failure by you to be present for an appointment (‘no show’) will incur a fee of 100% of the consultation.
If your appointment is cancelled by Bump2Breast Lactation, no financial penalty will be incurred by you.
If in the event your appointment is cancelled by Bump2Breast Lactation, and no suitable replacement appointment can be arranged in a reasonable timeframe, your full booking will be refunded.
New appointment times are subject to availability.
6. Delivery of Services (eg business hours, ongoing support)
Bump2Breast Lactation normal business hours are 9.30am-4pm Mon, Wed & Thurs, and by appointment at the Lactation Consultant’s discretion outside of these times. Correspondence, phone calls and support outside of normal business hours are at the discretion of the Lactation Consultant.
The Lactation Consultant does not provide an on-call service. If you require emergency care please call 000 or contact the 24 hour ABA helpline on 1800 686 268 or 13HEALTH on 13 43 25 84.
Initial Consultation appointments include 1 week of SMS, phone &/or email support within business hours. Ongoing support outside this length of time can be purchased as a separate follow-up appointment. Fees for add-ons are not refundable, including where you fail to utilise purchased add-on options fully within the time period stipulated.
“Initial Consultation” means your first consultation with the Lactation Consultant.
7. Provision of Information
You agree to provide complete and accurate information on the New Client Intake Form, including your personal details to enable the processing and delivery of the Services. The Lactation Consultant will not be liable to you or a third party for any loss for a delay or failure to process, fulfil or deliver the Services due to inaccurate or incomplete personal details.
8. Privacy Policy

9. Medicare Rebates
Medicare rebates may be available for some Midwifery Services. You are responsible for submitting a claim with Medicare for a rebate. The Lactation Consultant does not have Medicare processing capability.
10. Private Health Funds
If you have private health insurance, you are responsible for liaising directly with your private health fund to determine if you are eligible for private health benefits in respect of the services you receive from Bump2Breast Lactation.
11. Dispute resolution process
Bump2Breast Lactation is committed to their clients and their customer satisfaction. If, in the event your are unhappy with the Services provided by Bump2Breast Lactation we encourage you to contact us at wendy@bump2breastlactation.com to discuss your complaint and rectify if appropriate.

12. Warranty and Warranty Claim
The Lactation Consultant does not provide any warranties or guarantees as to the accuracy, completeness or suitability of the Services for any particular purpose, nor does the Lactation Consultant provide any warranties or guarantees as to the results which may be achieved through the provision of the Services.
All terms, conditions, warranties, undertakings, inducements or representations whether expressed, implied, statutory or otherwise relating in any way to the Services supplied to you which are not expressly stated in these Terms and Conditions are expressly excluded.
13. Limitation of Liability
To the extent permitted by law I, Wendy Hilless IBCLC of Bump2Breast Lactation will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
Any limitations on liability will survive termination of the Services.
14. Indemnity
You hereby indemnify the Lactation Consultant against all claims, demands, remedies, suits, injury, damages, loss, costs, liabilities, actions, proceeding or right of action (including legal costs on an indemnity basis) arising from (but not limited to) your use of the Services (including negligence) which results in loss, injury or damage (including death) to any property or person.
All indemnities survive termination of the Services.
15. Force Majeure
The Lactation Consultant will not be liable to you for any loss, damage or expense caused by the Lactation Consultant failure to supply the Services as a result of fire, flood, tempest, earthquake, riot, civil disturbance, theft, crime, strike, lockout, breakdown, war, the inability of the Lactation Consultant’s normal suppliers to supply necessary materials or any other matter beyond the Lactation Consultant’s control.
16. Copyright
All copyright, data, text, software, images, graphics, trademarks, logos, interfaces, catalogues, brochures, flyers, photographs, and other intellectual property ("the Content") on the Website or provided as part of the Services is owned, controlled by, or licensed to the Lactation Consultant. You must not use, copy, modify, reproduce or distribute the Website or the Content without the Lactation Consultant’s prior written consent. You must not frame or embed in another website any of the material appearing on this Website without the Lactation Consultant’s prior written consent. You may view and print the Content on your personal computer for the sole purpose of viewing the Content and purchasing the Services, but not for any other use, including any commercial use. You must not use any of the marks or trademarks appearing on this Website or the Lactation Consultant’s name without the Lactation Consultant’s prior written consent.
17. General
If any provision of these Terms and Conditions becomes void or unenforceable, it will be severed from this agreement without affecting the enforceability of the other provisions which will continue to have full force and effect.
These Terms and Conditions are governed by the laws of Queensland, Australia and each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Queensland, Australia.
The Lactation Consultant reserves the right at all times to make changes to these Terms and Conditions. Any variations to these Terms and Conditions will take effect from posting on the Website. The Terms and Conditions which apply at the time of signing the New Patient Form are those that govern the agreement between you and the Lactation Consultant with respect to those Services.
A failure or delay by the Lactation Consultant to exercise a power or right under these Terms and Conditions does not constitute as a waiver of that power or right, and the exercise of a power or right by the Lactation Consultant does not preclude its future exercise or the exercise of any power or right.
